I am Pek Woey Yi and owner of of Malee Mineral Water Sdn. Bhd.
On 11 April 2018 the Assistant Environmental Officer together with another officer have performed routine sampling tasks for the purpose of food sampling at 7 eleven
They have selected and purchased three bottles of "Aktif" brand mineral water measuring 1.5 litres for each
The officer brought a bottle of mineral water and athe public health laboratory in Sungai Buloh for analysis purposes
After analysing it was found that the mineral water contains 33 mg / l sulphate and 13.4 mg / l chloride
You committed an offence under section 13b (1) together with section 13b (2)(d) under Food Act 1983 that is selling food that contains any ingredients the addition is not permitted under this act or any regulation made in under this act can be punished under section 13b (4) under the same act
he did not agree with the charges against him because his company had certificates from government departments that gave permission and confirmed the production, processing and distribution of mineral water produced by his company
He also submitted a Halal Certificate from JAKIM, accreditation certificate, HACCP certificate and so on to explain to the court that the mineral water produced by his company in accordance with the rules
The court found that in the case, even though defendant bought salt supply from another company, it was still his responsibility to ensure that the salt content was safe before being repackaged by his party
After hearing the explanation of witnesses, exhibits submitted and arguments of both parties, the court was satisfied to decide that the defense had failed to raise reasonable doubts about the prosecution case, then the court found that the prosecution had succeeded
Pek Woei Yi, as director of Malee Mineral Water Sdn Bhd was found commit an offence under s. 182A of the Criminal Procedure Code for selling non-compliant beverage products specified in the Food Regulations 1985 and Food Act 1983. On this first charge, the court has imposed a fine of RM9000, failing to pay 12 months imprisonment.
